LEADER OF A TORY INSURRECTION---"by refusing to pay taxes and to furnish their
quota of men to serve in the militia. John Claypole, near Lost River, WV, a scotsman by birth,
headed the insurrection..."

John CLAYPOOL was born on 26 Sep 1733 in Cedar Branch, Rockingham, VA. (3) In 1781
he became rebellious over taxes but later pardoned by Gov. Nelson as "he conceived the act of

assist local officers in enforcing order, but finding the tories at Brake's too strong they withdrew.

1781: "We are under the disagreeable necessity of troubling you for assistance immediately. I
received an express from the commanding officer of this county for three hundred men from
Frederick County. Yesterday the militia of this county marched to Captain Stump's, there made
a halt, and sent a party of light horse to see what discoveries they could make about Jacob
Brake's mill on the South Fork. They were repulsed by fire and got off without any loss and
brought with them two prisoners. They can't make any discovery as to the number of the enemy.
I understood from Powell who came from Claypoles's (the commander of the tories) that he
expected by last night to command one thousand men. I think the only sure remedy to apply
would be to prevail upon General Morgan to take...amongst them, they are dailey daring him.
Let the men be officered and well armed." (5)

The other plot or conspiracy for an uprising was east of the Alleghenies in the region now
included in Hardy, Grant and Pendleton counties but part of which was then in Hampshire
county. The center of the plot was near the site of Petersburg in Grant county. A number who
were implicated in the conspiracy lived twenty miles above at Upper Tract and others on the
Moorefield river near the base of the Shenandoah mountains. Their purpose was first shown by
their refusing to pay their taxes or to contribute to Hampshire's quota of men for the army. When
Colonel Van Meter was sent from Oldsfields with thirty militiamen to enforce the payment of
taxes, fifty Tories armed themselves and assembling themselves at the house of a German,
named John Brake, declared that they would resist the demands by force. Van Meter, finding
that their strength was greater than he had anticipated, thought best not to attack at that time.
After attempting to convince them by arguments that they were in the wrong, he returned to
Romney, leaving them still in arms and defiant. The Tories, regarding themselves as victorious
became more insolent. They organized a company, elected John Claypole as their captain and
prepared to march away to join the British along the eastern coast as soon as the opportunity
might present itself. Their self-confidence and defiance resulted in their ruin. General Daniel
Morgan of the Continental army learned of their organization while he was in Frederick county,
about sixty miles distant. Collecting 400 militia, he advanced against them and without attempting
to open any parley or argument, as Van Meter had done, he pressed them closely and
completely conquered them, shooting several and accepting the surrender of Claypole and
Brake. Many of those who had been so defiant made amends by joining the American army and
by fighting until the end of the war.

History of West Virginia and the People Chapter VIII Western Virginia in the Revolutionary
War

They thought themselves victorious and became more insolent and defiant than before. They
organized a company, elected John Claypole their captain, and prepared to march off and join
Cornwallis as soon as he arrived within reach of them. They seemed to be fairly well posted on
the movements of the British army which at that time was threatening lower Virginia. General
Daniel Morgan of the Continental army happened to be at that time in Frederick county, some
sixty miles distant. Learning that the tories had organized a military company he thought it time he
took a hand. He collected 400 militia and did not open parley with the insurgents, but pressed
them so closely that Claypole surrendered, and William Baker was shot when he refused to
throw down his gun; but he was not killed. After one other had been shot, Brake surrendered,
and the tory uprising was at an end. When the tories duly reflected upon what they had done
they repented, and in order to make amends, they joined the American army and fought till the
end of the war. A cavern is pointed out seven miles from Upper Tract which is still called Tory
Cave, because of a tradition that some of the terrified men who escaped General Morgan's
militia were hiding in it for some days.
